Terms & Conditions



THE FOLLOWING TERMS AND CONDITIONS ARE PART OF THE CONTRACT SET FORTH ON THE OTHER SIDE HEREOF and binding on the parties thereto.

 

  1. ACCEPTANCE: All contracts, quotations and orders are not enforceable until accepted by another management representative of Pacific Coast Roofing & Contracting Ltd. Non. Acceptance by the management representative may be for credit reasons or otherwise.

  2. A negotiable promissory note bearing even date herewith and payable upon the same terms is being given by the buyer to seller contemporaneously herewith as evidence but not in payment of said total deferred balance.

  3. Title and ownership in and to the materials shall remain in the seller’s name at buyers’ risk until entire purchase price, interest and all costs are fully paid in cash including payment of any note or extension given or judgement secured. Buyer will not part with the possessions of the materials and will keep the materials in good condition and free and clear of all liens and encumbrances. Seller may pay any item or charge upon the material or property to which the materials are affixed and add the amount thereof to the amount hereby secured and the whole amount hereby secured shall fall due forthwith.

  4. Buyer agrees that seller shall not be liable for delays in or failure to complete delivery or installation of all or any of the said materials if due to fire, strikes, weather conditions, war, government regulations or any causes beyond the control of the seller.

  5. Buyer agrees that extra material on the job site that are not required under this contract are the property of the seller and must be returned to the seller on the completion of the contract.

  6. Seller agrees that all work done by the seller will be performed in a workmanlike manner.

  7. Buyer agrees to execute credit applications aand to supply all information for the proper establishment for credit immediately upon request by the seller. Buyer agrees to execute any promissory note, completion certificate or other documents required by the seller in connection with his contract. In the event the buyer credit is not approved, seller may cancel this contract and the buyer will be refunded any payments made by the buyer but shall not be entitled to any further claim.

  8. There are no representations, collateral agreements, conditions or warranties, expressed or implied, by statute or otherwise on the part of with respect to the said material or this contract affecting the rights of the parties other than as specifically contained therein or attached hereto forming part of this contract.

  9. This contract, all its covenants, promises and conditions shall endure to the benefit of and be binding upon the respective heirs, executors, administrators, successors and assigns of the parties hereto.

  10. It is expressly agreed by the parties hereto that should the buyer default in performance of the conditions contained in this contract, then the deposit paid at the time of execution of this contract to the seller, shall at the option of the seller, be designated liquidated damages and payable forthwith to the seller.

  11. It is understood and agreed that this contract is binding under the terms and conditions of Provincial legislations and further understood and agreed that if the buyer at any point refuses to complete the contract for any reason whatsoever the buyer agrees to reimburse the seller for all costs, expenses and disbursement. Including sales commission, incurred by the seller.

  12. It is understood and agreed that the contractor will furnish only such materials and labour as is written on the face of this contract and it is further understood that all verbal or written agreements not mentioned on the face of this contract are void and no salesman has any authority to change, Aller or add to this contract in any particular.

  13. Buyer agrees to allow seller access to said properly to complete this agreement.

  14. The buyer agrees to pay Pacific Coast Roofing & Contracting Ltd. In addition to any monies due under the terms of this contract, all legal costs expenses incurred by Pacific Coast Contracting Ltd. In collecting monies due from the buyer, shall be added to the amount owing and shall bear interest at the aforesaid rate.

Terms and Conditions for Free Quotations

1. Request for Quote:

Customers must initiate a request for a free onsite quote by contacting Pacific Coast Contracting through our official channels.
A detailed description of the scope of work must be provided during the initial communication.


2. Scheduling the Onsite Visit:

Upon agreement with the customer, Pacific Coast Contracting will schedule a convenient time for an onsite inspection by our expert.
The customer is responsible for ensuring access to the property during the scheduled visit.


3. Onsite Inspection:

Our expert will conduct a thorough inspection of the property to assess the scope of work, gather necessary details, and evaluate requirements for the project.


4. Quotation:

Pacific Coast Contracting will provide a detailed quotation to the customer based on the information gathered during the onsite inspection.
The quotation will be valid for a period of 30 days from the date of issuance.


5. Acceptance of Quotation:

Customers are required to accept the provided quotation within the 30-day validity period to lock in the quoted price.
If the acceptance is not received within 30 days, Pacific Coast Contracting reserves the right to reevaluate and requote the project, considering potential changes in material and labor costs.


6. Requoting After 30 Days:

If the customer decides to proceed with the project after the 30-day validity period has expired, Pacific Coast Contracting may need to requote the project to reflect any changes in material and labor costs.


7. Customer Responsibilities:

Customers must provide accurate and comprehensive information during the initial communication to ensure an accurate onsite quote.
Timely acceptance of the quotation is essential to secure the quoted price.


8. Limitations:

The free quotation provided by Pacific Coast Contracting is an estimate based on the information available during the onsite inspection and is subject to change if there are modifications to the scope of work.


9. Modification or Cancellation:

Pacific Coast Contracting reserves the right to modify or cancel the free quotation at its discretion, especially if there are significant changes to the project requirements or unforeseen circumstances.


10. Governing Law:
- These Terms and Conditions shall be governed by and construed in accordance with the laws of Greater Vancouver.

By requesting and accepting a free onsite quotation from Pacific Coast Contracting, the customer acknowledges and agrees to abide by these Terms and Conditions.
